Dear Faizan Aziz:
It has been over 28 years, but your father A. Aziz Qader and uncle Mohsin have not remitted a single penny of the returns and principal from the investments in Bangalore properties my late father Noor Mohamed Lodhia made through them. They have also vehemently refused to provide official documentation of those investments including when the properties were sold, at what price and to whom.
Since you are part of the family business, you must have full knowledge of the money trail in your accounting books. As a direct beneficiary of the money your father Aziz Qader and uncle Mohsin received from Noor Mohamed Lodhia and subsequently stole from his heirs, you are thereby socially, morally and legally responsible for their actions.
My father Noor Mohamed Lodhia was a very trusting soul, working tirelessly for the betterment of his motherland India and its people, especially his fellow Memons. Little did he know that Aziz Qader and Mohsin would trick him, a 72 year old man, into handing over his hard-earned life savings to them, about 85 lakh rupees, for a share in Bangalore properties they owned by dangling the prospect of an imminent, favorable zoning decision by the Indian government that was guaranteed to increase the land value significantly. In anticipation of that event, they discouraged him from registering his properties. In essence, Aziz Qader and Mohsin, a couple of novice, small-time operators, were able to get their hands on 85 lakh rupees from a single investor, an immense amount of money in 1995, to fund their other investments instead of borrowing from the banks at 16.5% per annum, the prevailing State Bank of India Advance Rate.
When my father was unexpectedly diagnosed with cancer in 1997, he requested Aziz Qader to sell the properties and return his money. Aziz Qader refused, telling him that the zoning decision they promised never materialized, rendering the properties unsaleable.
After my father passed away in 1998, Aziz Qader and Mohsin continued their con game with his heirs, using every ruse in their playbook to deceive, defer, deflect, delay, and then ultimately deny that Noor Mohamed Lodhia had made any investments through them in Bangalore properties.
The mountain of evidence on www.suchbolo.com, including the criminal charges approved by the Bangalore City court, is corroborated by the most damning witness - the voice of your own father Aziz Qader himself in recorded telephone calls - leaving no doubt that Aziz Qader and Mohsin had every intention of withholding the money invested by Noor Mohamed Lodhia, including the profits earned, and making wrongful gain for themselves. Worse still, Aziz Qader confessed to systematically manipulating their accounts, consequently defrauding the Indian government out of much needed tax revenues. Here are some highlights of their legerdemain:
- Aziz Qader and Mohsin convince Noor Mohamed Lodhia to open a HSBC bank account in Bangalore having the address of their company, Frontline Constructions!
- Aziz Qader, upon learning of Noor Mohamed Lodhia's death, sends a condolence letter to USA via EMS Speed Post confirming the property investments but stipulates that the heirs, who are residing in the USA, must travel 9,000 miles to Bangalore if they want any details.
- Aziz Qader, in recorded telephone calls, describes a deliberate scheme of hiding monies ("Upar ka Paisa") received from his clients and relatives worldwide.
- In 2000, Aziz Qader, in recorded telephone calls, suggests waiting a little bit longer for the property values to increase, especially the Whitefield/Ashton Park land of which he also owns 500,000 square feet.
- In 2005, Aziz Qader makes a lowball offer to buy back Noor Mohamed Lodhia's properties, requesting USA bank account numbers for immediate payment, when the current market value is more than triple, INR 1,000-1,200 per square foot, as verified by Irfan Razack and Zackria Hashim of Prestige Group.
- In 2005, Aziz Qader tries but fails to reactivate and deposit money into the closed Bangalore HSBC bank account of Noor Mohamed Lodhia seven years after his death. Were Aziz Qader and Mohsin desperate to "clean the money trail" in their accounting books?
- In 2006, Aziz Qader visits Pakistan and tells Razak Teli of Nakshbandi Industries that Noor Mohamed Lodhia’s properties has been sold, without the consent of his heirs, and payment will be remitted within two months.
- In 2007, Aziz Qader and Mohsin personally acknowledge that they unilaterally sold the Whitefield/Ashton Park land to a farmer years ago but refused to provide any documented proof or disclose whether Aziz Qader also sold his own 500,000 square feet of Whitefield area/Ashton Park land to that farmer.
- In 2007, Aziz Qader and Mohsin meet Hanif Anver Tayub in Bangalore and tell him that they intend to remit only the smaller amount of money officially showing in their accounting books through normal banking channels but the larger amount of money will be sent through Hawala.
- In 2007, Aziz Qader, in a recorded telephone call, insists that his and Mohsin’s decision to misreport investment monies received from Noor Mohamed Lodhia, thereby cheating the Indian tax authorities, is now a joint problem with the heirs of Noor Mohamed Lodhia.
- In 2008, Aziz Qader discloses, almost ten years after the death of Noor Mohamed Lodhia, that he and Mohsin still have INR 25,80,650 received from Noor Mohamed Lodhia as an advance.
- In 2008, Aziz Qader hoodwinks Haji Mohammed Omar, Founder of Brandix Sri Lanka and father-in-law of his sister Amina, saying that no one was aware that he had money belonging to Noor Mohamed Lodhia.
- In 2008, Aziz Qader and Mohsin assure Haji Mohammed Omar that they will remit money to the heirs after they obtain permission from the Reserve Bank of India.
- In 2009, Aziz Qader threatens to "disown the full amount" of investments made by Noor Mohamed Lodhia if anyone of his heirs sought the help of an attorney.
- In 2009, Aziz Qader and Mohsin ignore multiple Legal Notices sent by advocate Sandesh J. Chouta of Bangalore demanding immediate payment to the official US bank account of the Estate of Noor Mohamed Lodhia.
If your father Aziz Qader and Mohsin had done this in the United States of America, both would be in jail facing maximum penalties and fines for elder abuse, tax evasion, and money laundering. Luckily, they are citizens of India, that is Bharat, one of the most corrupt countries in the world, where the dishonest police officers, judges, and government officials are all on the take. No wonder the well-to-do can freely commit economic crimes with impunity and amass their wealth through creative tax evasion schemes coupled with illicit money outflows from India to black money paradise like Dubai.
Finally, a question on everyone’s mind when they learn about the chicanery of your father Aziz Qader and Mohsin: If they truly believed in Allah and the Last Day, how can they sleep at night knowing that they continue to hold on to a dead man’s money, unjustly enriching themselves while depriving the heirs of their rightful inheritance? No, sporting an Islamic beard, performing ostentatious salat and making multiple trips to Makkah and Madinah for Hajj and Umrah won’t absolve Muslims of their wrongdoings and get them a free ticket to heaven.
Thank you for your attention to this matter.
